What is PII?
PII is any information that can be used to personally identify you, including, but not limited to:
How CDS Uses Your PII
- Information you provide in connection with your registration to access the HOA Database, including your name, mailing address, telephone number and e-mail address; and/or
- Activity information about your HOA Database account; and/or your interactions with the CDS customer service and/or technical support representatives over the telephone or via e-mail.
CDS uses your PII to (i) provide you access to the HOA Database; (ii) establish your customer account for access to the HOA Database and to manage customer access records; (iii) contact you about your account; (iv) provide you with additional information that may be of interest to you such as news about CDS; (v) provide customized technical support; (vi) monitor your access and usage records for the HOA Database; (vii) monitor and protect our HOA Database; (viii) protect against fraudulent, abusive, unauthorized or unlawful use of the HOA Database.
How CDS Protects the Security of PII
CDS has implemented an information security program that contains administrative, technical and physical controls that are designed to safeguard your PII and non-personally identifiable information. We use industry standards to secure PII when it is being collected and transmitted over the Internet as well as firewalls, security monitoring, encryption and intrusion detection software. Although we cannot guarantee that our information security program will prevent every unauthorized attempt to access, use or disclose your PII, we maintain security and incidental response practices to handle incidents involving unauthorized access, use or disclosure of your PII.
Under our practices and policies, access to PII is authorized only for CDS employees and contractors who have a business need for such access, and records are retained in accordance with applicable laws and then securely destroyed. CDS employees and contractors are trained on the importance of protecting privacy and on the proper access to, use of and disclosure of PII.
As an extra precaution, you should not share your password with anyone. CDS will only ask you for your password as part of a customer service or technical support call, and only in cases where you request customer service or technical support in connection with your HOA Database account.
Sharing of PII in Limited Circumstances
CDS will not share, sell or license your PII to third parties for their marketing purposes without your consent. CDS may disclose your PII in response to:
- Subpoenas, court orders, search warrants or other valid legal process, or as otherwise authorized by law;
- Circumstances where CDS has a good faith belief that a crime has been committed by a CDS customer or visitor;
- An emergency that poses a safety threat to you or another person; or
- Possible violations of the CDS Acceptable Use Policy or other CDS policies in the Legal Disclosures section of this website.
When CDS uses third parties to perform business functions on our behalf, we require them through contracts and agreements to treat your PII confidentially and to only use your PII for the express purpose of providing the specific business functions for CDS.
If the ownership of CDS changes, including as a result of a merger, acquisition, or the sale of its assets, your PII may be transferred or assigned as part of the transferred assets. If such a transfer results in a material change in the use of your PII, we will notify you about the material change.
This Non-PII does not identify you personally, but includes technical information such as your Internet Protocol or IP address, operating system, and browsing and linking activity while using our website and the HOA Database.
CDS also uses advertising networks that customize and serve third party advertisements or other content on our website and the HOA Database. The servers of these advertising networks place and access cookies and similar technologies in browsers to collect Non-PII identification about your visits to our website and the HOA Database. These kinds of tracking and analytics are done in the aggregate and are anonymous.
CDS uses third-party advertising companies, including Google AdSense, to serve ads when you visit our website and the HOA Database. These companies may use aggregated information (not including your name, address, e-mail address or telephone number) about your visits to our website and the HOA Database in order to provide advertisements about goods and services of interest to you. This website and the HOA Database contains links to third-party websites. CDS is not responsible for the privacy practices or the content of such websites. You may establish a hypertext link to this website or the HOA Database so long as the link does not state or imply any sponsorship of your website by CDS. However, you may not, without the prior written permission of CDS, frame any of the content of this website or the HOA Database, or incorporate into another website or other service any intellectual property of CDS.
Protection of Children
Protecting children’s privacy is especially important to CDS. You must be 18 years of age or older to use our HOA Database. CDS does not knowingly ask for or collect PII from any person under the age of 18.
CDS recommends that children ask a parent for permission before sending any PII anywhere using the Internet.
California Privacy Rights
California Civil Code Section 1798.83, also known as S.B. 27, allows our California customers to request certain information regarding CDS disclosures in the prior calendar year, if any, of PII to third parties for their own direct marketing purposes.
